MS NOW’s Nicole Wallace asked Jack Smith, former Department of Justice Special Counsel, point blank if he expects to be indicted after Smith attempted to bring two sets of criminal charges against President Donald Trump.
On Dec. 17, 2025, Smith testified before the House Judiciary Committee in an eight-plus hour, closed-door session on his investigations into Trump’s retention of classified materials at his Mar-a-Lago residence and attempts to overturn the 2020 election results.
Smith then appeared in his first public testimony before the committee on Jan. 22. As he testified, Smith said he anticipated Trump’s Department of Justice officials would do “everything in their power” to prosecute him based on orders from the President.
Nonetheless, he also warned, “I am not going to be intimidated. We did our work, pursuant to department policy. … I’m not going to pretend that didn’t happen because [Trump is] threatening me.”
Trump has repeatedly slammed Smith, calling him a “deranged animal” and encouraging a DOJ investigation, “Hopefully the Attorney General is looking at what he’s done”, in a post to Truth Social.
During his MS NOW appearance, as Smith pondered the future of the DOJ and encouraged young lawyers to still apply for positions in the department, Wallace asked, “Do you expect to be indicted?”
“Listen, Donald Trump has made a bunch of statements, ” Smith began.
“He said he would indict you,” Wallace added.
Smith glossed over the question by maintaining his focus on the DOJ, not on Trump:
I’ll tell you, Nicole, I honestly do not spend a lot of time thinking about the things he says about me and his threats about me. I’m real focused on the people who I worked with, looking out for them. I’m real focused on how the Justice Department is going to be better going forward, things like that. In my situation, I did my job the right way. I had an all-star team. I mean, Nicole, the agents on my case, if I were to walk you through all the awards they’ve won throughout, you know, generations of administrations, we would be here all night. These were superstars. And I’m much more concerned that those people get to serve in the department, get to serve in the bureau again someday.
