The U.S. government has officially refunded $86.3 billion in Trump administration tariffs following a landmark 6-3 Supreme Court ruling last February that struck down the sweeping import taxes as unconstitutional. 

Since the ruling, more than 330,000 businesses have submitted claims for more than $166 billion in duties collected. 

Trump's tariffs were imposed under the International Emergency Economic Powers Act (IEEPA), but the Supreme Court ruled that the statute's authority to "regulate importation" does not grant the president the power to levy taxes or tariffs, affirming that this power belongs to Congress.

As of July 10, 2026, according to World Trade Online, about $121.75 billion in claims had been accepted and roughly $86.3 billion actually repaid to importers (including interest), over half the pool is now paid, with $49.1 billion of it disbursed in June alone, according to the Treasury Department's monthly statement.

The refund process began to amp up on April 20, when the U.S. Customs and Border Protection began accepting applications through its Consolidated Administration and Processing of Entries (CAPE) process for refunds on tariffs that the Supreme Court struck down in February.

In June alone, the U.S. paid out $49.2 billion in refunds, which was more than the $23.6 billion in gross customs duties that the agency took in during that time period. That payout was more than twice the approximately $22 billion disbursed the previous month, when refunds and collections were close enough to nearly cancel each other out, leaving a net outflow of just $42 million.

Roughly $80 billion of the pool remains unpaid. According to Brandon Lord, Executive Director, Trade Programs Directorate, Office of Trade, U.S. Customs and Border Protection (CBP) 8,384 approved declarations have no valid banking information. These claims are fully approved, the money is authorized, but CBP pays by ACH only, and the refund cannot move until the importer fixes routing/account details in ACE.

Entries with antidumping/countervailing duties, active drawback claims, or open administrative protests are held for manual handling. Phase 2 (live since June 29) started clearing the AD/CVD backlog, but throughput is slower than Phase 1's clean entries.
